What would you do if an agent became incapacitated and could not continue the transaction?

Most brokers don't think about it until it happens to one of their agents, says Chance Brown, Broker/Owner of CB&A, REALTORS® in Houston and Texas Real Estate Commission Vice-Chair.

"The first time it happened to me, I had nothing in place," he says. "I was completely blindsided. After I got into the transaction and got everything taken care of, I changed my brokerage policies."

Agents and brokers can take a few simple steps ahead of time to help everyone involved if the worst ever happens.

Up-to-date, detailed notes are key

The easiest way to keep the transaction moving is for agents to regularly upload their notes and communications into their CRM, Brown says. Emails, text messages, and even contact information would be essential if someone needed to step in to finish the deal.

Brown recommends that agents dedicate 15-20 minutes a week to updating their files and discourages waiting until the day before the closing to upload everything. Agents can even use AI to help streamline this task but should avoid putting personal or confidential information into AI and should review the finished product to ensure that it is accurate.

Database access helps brokers keep going

An updated CRM is great, but can the broker access it? Brokers should make sure there is a way they can access agents' systems in case something happens, Brown says. Without it, a broker may be starting at step one while everyone else is getting ready for closing.

Clear office policies chart a path forward

Brokers' detailed policies and procedures for their brokerage should include plans for incapacitated agents. This could include decisions about how an agent would be paid for the part of the transaction he or she was able to complete.

This kind of planning isn't fun to talk about, but it's important for the continued success of your business and to fulfill your responsibilities to your clients.
