What May Change in the Lease Agreement, Related Forms

Texas REALTORS® needs your feedback on changes to the Residential Lease (TXR 2001) and 10 other property management documents. Your responses help the association make these documents as useful to you as possible in your transactions. Share your thoughts before October 24.

Residential Lease

  • Defines of “Tenant” and “Occupant”
  • Includes monthly rent, prorated rent, late fees, and security deposit so that the parties can easily see the bulk of the recurring monetary responsibilities in one place
  • Adds an option for security deposit date to include checkboxes: now includes on or before execution of the lease, or a blank line for a date should a landlord require receipt of the security deposit on a specific date prior to execution
  • Clarifies the Automatic Renewal and Notice of Termination language
  • Consolidates rent details including time and place of payment, payment method, rent increases, and first month’s rent
  • Clarifies guest language
  • Updates move-out condition paragraph to reflect that the property should be surrendered in a clean condition
  • Adds water softeners to tenant’s responsibility list
  • Adds a clause to exclude tree trimming from yard maintenance to ensure safety
  • Adds a clause to repair requests, as some new local ordinances may determine HVAC is an emergency repair
  • Includes a summary of the Protecting Tenants at Foreclosure Act
  • Adds reference to Early Termination of Residential Lease (TXR 2012) as an alternative agreement the parties can use
  • Removes all references to assignment or subletting
  • Strengthens wording to comply with Senate Bill 38, effective January 1, 2026, in which notices can be sent via email if the parties agree to it in writing.

  • Residential Lease Amendment (TXR 2014)
  • Addendum Regarding Fee in Lieu of Security Deposit (TXR 2018)
  • Lease Amendment Concerning Tenant Change (TXR 2211)
  • Itemization of Security Deposit (TXR 2216)
  • Notice of Late Rent Breach of Lease (TXR 2230)

ADDITIONAL PROPOSED REVISIONS

Residential Lease Application (TXR 2003)

A paragraph was added regarding Senate Bill 17, the Foreign Acquisition of Texas Property law effective September 1, to put the applicant on notice that they should seek an attorney if the law might be applicable to applicant(s).

Residential Leasing and Property Management Agreement (TXR 2201)

A reference to subagency was removed to bring the form in compliance with the new TREC housekeeping law, effective January 1, 2026.

Residential Lease Sight Unseen Addendum (TXR 2017)

This form is being considered for removal, as the form’s language is already in the Residential Lease
